Sunset Bay POA - 2012 Annual Assessments and News

The Sunset Bay board has decided to extend the 2012 annual assessment due date two weeks from March 1, 2012 to March 15, 2012 due to the 2012 annual assessment invoices being mailed out later than intended and to make up for the short notice some property owners may receive. Most property owners should be receiving the assessment invoice about now. Some property owners have already sent in payments early. Please make every effort to mail in your 2012 annual assessment of $295.00 by March 15.
There is a Sunset Bay calendar card enclosed in each invoice, please note there is an error on the Sunset Bay mailing address zip code which should be "77903".
The board has approved a bid to construct a concrete parking area, concrete access road, and concrete walkway leading from the parking area to the entrance of the fishing pier as a needed improvement in the common area. Details are being finalized with the contractor now and should be starting work within a week. More information later.
Also we are excited to see a new home construction that is already in progress at 107 Dockside Dr. ( Blk 3, Lot 28 ) owned by Tim and Rosa Raub. It will be a very welcomed addition and sure that Tim and Rosa Raub are excited as well.
Please be aware that the board has waived new home application processing fees until 6/30/2012. We want to see more new homes starting up.
We are aware of HB 2761 that has passed recently by the Texas Legislature effecting all Texas property owner associations with some changes summarized below:

·         Open HOA Meetings 
·         Mandatory records retention policy for all Texas HOAs of over 14 lots
·         Open access to records by written request
·         Mandatory election for a new board, if an HOA fails to call a regular meeting
·         Requires meetings be held in the same county as the HOA
·         Establishes HOA cannot foreclose for fees owed for requests for records
·         Eliminates certain rules which restrict voting rights and the right to run for the board of HOA’s

Final Notice on Delinquent Sunset Bay POA Annual Maintenance Charge

The Final Notice was mailed to all delinquent Sunset Bay property owners on 8/16/2011 who are not current with the Sunset Bay Annual POA assessments. Please contact the POA Treasurer, Josh Staley (830-832-1503) to make arrangement for payment if you cannot send in full payment within 30 days of postmarked date of Final Notice.

Please review the POA Covenants regarding "Failure to Pay Maintenance Charge" as an attorney has been contacted and Liens will be filed against all delinquent properties after 30 days of the postmarked date on the Final Notice recently mailed out on 8/16/2011.

The association will be filing Liens from this time forward for "Failure To Pay Maintenance Charge" on all delinquent property owners not complying to the payment of POA assessments as per the Sunset Bay Covenants, Conditions, and Restrictions (CCR's).

Sunset Bay Annual Members Meeting News

Hi All
The 2011 Sunset Bay Annual Members meeting was called to order and convened yesterday evening in Rockport, TX at the Woman's Club of Aransas Pass. The minutes of the meeting will be posted soon on the POA website once reviewed and approved by the board.
I have resigned as President of Property Owners Association of Sunset Bay, Inc. but will remain on the board as "Director at Large". I have served as President of the POA Board of Directors for three years now and it is time for someone else to step up and guide the POA of Sunset Bay and its community to be great place to live. We have accomplished a lot of positive things in growing as a self managed POA despite a stagnant economy and look forward to good things to happen soon to jump start some new home construction within the Sunset Bay community.
Vice-President Debbie Otiz will be stepping up to President of the Board who is quite capable. Also Dave Kasprazak has resigned fro the board and we have Tim Raub joining the board now as Vice-President. Tim is an practicing attorney in Corpus Christi and we welcome him to the board. We want to thank Dave for his time and input while serving on the board this past year. Also I want to thank Gary Sequeira and Josh Staley for all the time and work they have put in while still serving on the board.
We will be going through a short transition phase while transferring certain responsibilities to the new President, Debbie Ortiz and updating the POA website contacts, etc.
I want to thank all the Sunset Bay property owners I have met and talked to who have supported the board and our common cause to make Sunset Bay a viable, great place to reside, and enjoy life at its fullest.

Sunset Bay News

Hi All,
By now most of you should have received the 2011 Annual Members Meeting notice for the Property Owners Association of Sunset Bay Inc. to be held on Saturday, August 13, 2011 at 2:00 pm in the Woman's Club of Aransas Pass in Rockport, Texas. Please make every effort to attend this annual meeting of Sunset Bay members to be involved in the community.
In order to conduct business at the Association meeting, a quorum of 10% of eligible members must be reached in person or by proxy.
We now have running water to the community fishing pier entrance and fish cleaning station. Also two 8 ft benches have been installed at the T-head so members will be able to sit while fishing or just enjoying the evening sunset's. Two 400 watt green fishing lights are in service at the T-head for fishing at night also. Also we have just completed applying decking preservative to the walkway / T-head decking and handrails on the pier to protect and extend the longevity of the pier being it is the primary asset and amenity we currently have in the common area.
There are some members that are still delinquent on the 2011 POA assessments and you must be current to be eligible to vote at the annual members meeting and to be able to access the fishing pier in the common area. The pier security gate code will not be given out unless you are current on the 2011 POA assessments.

When entering the common area to access the fishing pier, please DO NOT drive upon or cross the levee into the wetlands area. Park your vehicles in the common area before you get to the levee that leads to the pier entrance. The developer had to re-plant some the native wetland grasses to replace what was killed during the construction phase of the pier and this is still in progress. So if you see the water lines and hoses in the wetlands these are for irrigating the grasses from time to time to get the replants growing. So again, please do not drive into the wetlands area or upon the levee (walking trail) with any vehicle.
